    The Court in Mabo, where Brennan J led majority, put an end to the notion of Terra Nullius, by which the British could claim that land in Australia was ripe for the picking because it belonged to no one, and opened the claims to land ownership to a much wider group including the traditional owners. The follow-up judgement in Wik took that understanding even further.

    'Most of his life, Dr Johnson was a priest. Most of his life, he started his day sharing this bread of life with the world. He spent his childhood years here in Rocky, and he enjoyed his twilight years here. Rockhampton was home. Yet the cosmopolitan Grove was ever so much more at home in Rome, Paris or Sydney. And he meant that as no offence to the people of Rockhampton.' Homily delivered for the funeral of the 94 year old priest Grove Johnson.

    On Aboriginal land: seeking a place at the table

    Indigenous leaders this last week have called for the creation of two new legal entities. They want a First Nations Voice enshrined in the Constitution, and a Makarrata Commission set up by legislation. The Makarrata Commission would supervise agreement making between governments and First Nations and engage in truth telling about history. The envisaged destination is a national Makarrata (or treaty). So the immediate constitutional issue is the creation of the First Nations Voice. There is no point in proceeding with a referendum on a question which fails to win the approval of Indigenous Australia. Neither is there any point in proceeding with a referendum which is unlikely to win the approval of the voting public.

    Australia is more mature and more complex than it was at the time of the 1967 Aboriginal citizenship referendum. We need to be very attentive to the diversity and (hopefully) emerging consensus of Aboriginal viewpoints. We also need to be attentive to what measures the leaders of our major political parties will be prepared to sponsor during the life of the next parliament, championing those measures in a referendum campaign.

  • Maintaining the humanity of the public square

    The phrase 'the public square' is peppered throughout Frank Brennan's work. The 1988 film Cinema Paradiso depicts the public square in a Sicilian village over 30 or so years, and its slow and subtle change from a place where human beings gather to laugh, play and discuss. Billboards and garish signs appear and it becomes a car park bereft of its humanity.

    'In chapter 12 "Respecting Autonomy and Protecting the Vulnerability of the Dying", Frank quoted my grandmother ... "Well there is not much to say about euthanasia is there? Just don't kill people and look after them while they are dying. What more can you say?" Well Grandma, I am not certain that I share your view. Just as Pope Francis did not know all the answers at age 36 years, neither do I.' Frank Brennan's nieces Shannon and Kateena help launch his new book Amplifying That Still, Small Voice.

    'As a legislator and a Catholic, I often felt gratitude for Frank Brennan's ambassadorship from the republic of conscience. I found the need to weave, this need to take 'data points' from many places and form my conscience. I regarded Frank as a bit of a hero.'
