While pro-Russian and pro-Western media have been spinning the Crimea crisis as either a heroic exercise in righting a past wrong or a land grab by a new Hitler, the legal position is far from straightforward, and there is more than enough hypocrisy to go around. The Crimean issue is perhaps best analysed not through the prism of international law but rather that of age-old great power politics.
To call someone a bleeding heart is an insult, not a description. It has no meaning but does have connotations. Those who call advocates for asylum seekers bleeding hearts usually dismiss ethical arguments. Although they may accept in the case of personal relationships that it would be wrong to inflict pain on people in order to deter others, they usually claim without supporting argument that governments are not bound by this ethical principle.
This week China criticised Australia's treatment of asylum seekers. The criticism, raised at a bilateral human rights dialogue, is good politics: China is using Australia's cruel and inhumane asylum policy as diplomatic leverage. Nevertheless, it is astounding hypocrisy from a country that returns refugees to danger, including to North Korea, a state infamous for its widespread violations of human rights.
Augustine wrote of the Roman Empire, 'Without justice, states are robber bands.' His mordant comment aimed to strip away the self-congratulatory rhetoric of empire from the reality of a Rome concerned purely with asking how to achieve desired goals uncontrolled by respect for human dignity. If we appreciate how robber bands work we can better understand what states do, including Australia.
In the clamour of Australia's treatment of asylum seekers, an almost unnoticed government direction struck a revelatory chord. It affects people who came to Australia by boat and have been found to be refugees and have protection visas, stating that any applications they have made to bring family members to Australia must remain at the bottom of the pile. The brevity of the direction belies its enormous effects on the people affected by it.
The current dispute with Indonesia over border incursions by the Australian Navy is symptomatic of a deeper problem — the militarisation of political discourse. Von Clausewitz famously claimed that 'war is politics by other means': in other words, that military force is employed in service of political ends. In Australia, as elsewhere in the West, this is being taken to an extreme not previously seen outside authoritarian societies.

Christmas tells the story of a God who entrusted Christ as a baby safely to the care of Mary and Joseph in a markedly hostile secular environment. The stories told at the Royal Commission are of parents who entrusted their children unsafely to the care of representatives of the Church. The face of Herod in our day is not that of a persecutor who threatens the church from without. It is that of a minister of the church who betrays from within.

From a liberal perspective the use of public money to fund free legal services to individuals is inherently undesirable. Even if the contracts are awarded under competitive tendering, the funding of the services is a distortion in the market. Ideally they should be left to the market to provide. And by definition they are less efficient than commercial organisations disciplined by a free and competitive market.
