Until now, there was some doubt whether the Parliament's constitutional power to make laws with respect to marriage would be broad enough to include laws with respect to same sex marriage. The High Court has put this matter beyond doubt with all six sitting judges affirming that 'marriage' for the purposes of defining the constitutional power of the Parliament could not be confined to marriage in the traditional Christian sense.
Governor-General Quentin Bryce's brief interventions on same sex marriage and the republic, though careful and aspirational, may submerge her earlier thoughts. She may come to regret not delaying them until after she leaves office. But more attention has been focused on the monarchy-republic issue when really the more instructive issue for the office of governor-general is the same sex marriage question.
In a welcome first step, the Vatican has invited lay Catholics to offer their views on the family. The document that accompanies the survey represents a fairly traditional Catholic theology of the family, setting it within a high theology and expressed in elevated language. This theology has been developed principally by celibate men, no doubt familiar with family life through their childhood and pastoral ministry, but at a distance from it.

Marriage equality advocates are pursuing the issue at a state level in the hope of pressuring the Commonwealth. In the process they risk blowing apart the national coherence of marriage laws put in place in 1961. The marriage equality question is best resolved by the Australian Parliament exercising a conscience vote. Marriage is too precious a social institution to be put in the mix of a dog's breakfast.
It may be that the press gallery sees no significance in Shorten’s 'Catholic background' because he supports same-sex marriage and perhaps also some other things that bishops don’t like. Is the gallery’s view that his 'background' somehow didn’t 'take'? In California alone there are already 40,000 children who are being brought up by same sex couples.
